Terms and conditions for using ThreadKeeper

These Terms of Service (hereinafter "these Terms") set forth the conditions for using ThreadKeeper (hereinafter "the Software") developed by the Developer (hereinafter "the Developer") and the related website (https://www.thethread-keeper.com/, hereinafter "the Site").
By downloading, installing, or using the Software, you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using the Software.
No special qualifications or conditions are required to use the Software. However, please note the following:
No registration or login is required to use the Software. There are no account creation or management procedures.
The Software operates entirely on the user's PC, and the Developer does not collect any information that could identify the user.
The Software is provided free of charge. There are no fees for downloading, installing, or using the Software.
However, when using the AI summary feature with an external AI provider's API, API usage fees according to each provider's pricing structure are the user's responsibility. If you choose Ollama (local AI), no API usage fees are incurred.
The Developer assumes no responsibility for API usage fees. Each provider's pricing structure is subject to change; please check each provider's official website for the latest information.
The Software is open-source software released under the MIT License. Subject to the conditions of the MIT License, the following uses are permitted:
The copyright notice and permission notice must be included in all copies or substantial portions of the Software.
The full text of the MIT License can be found in the LICENSE file included in the Software's source code repository. In the event of any conflict between these Terms and the MIT License, the MIT License shall prevail with respect to the use of the source code.

To use the AI summary feature, users must obtain an API key from an AI provider and configure it in the Software.
When using the AI summary feature, the terms of service and privacy policies of the selected AI provider apply. Users should agree to each provider's terms before using the API.
API usage fees charged by each AI provider are the user's responsibility. The Developer assumes no liability for API usage fees. When using Ollama (local AI), no API usage fees are incurred.
Users shall not engage in the following activities when using the Software:

The Software is provided "AS IS." Under the MIT License, no warranty of any kind, express or implied, is made regarding the Software, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Except in cases of willful misconduct or gross negligence by the Developer, the Developer shall not be liable for any damages arising from the use or inability to use the Software, including but not limited to direct, indirect, incidental, special, consequential damages, data loss, business interruption, or lost profits.
In accordance with the foregoing, the Developer specifically assumes no liability for:
If the user qualifies as a "consumer" under the Consumer Contract Act, the provisions of the Consumer Contract Act and other mandatory laws shall prevail over any conflicting provisions in these Terms.
Even in cases where the Developer is liable for damages, such liability shall be limited to direct and ordinary damages actually incurred by the user, and shall not exceed the total amount paid by the user to the Developer in connection with the Software (since the Software is provided free of charge, this cap is zero). This limitation does not apply to damages caused by the Developer's willful misconduct or gross negligence.
The source code of the Software is released under the MIT License. However, the following intellectual property rights are retained by the Developer:
Use of the source code within the scope of the MIT License is free, but prior permission from the Developer is required to use the above name or logo.
The Developer may modify, update, or discontinue the Software's features without prior notice. The Developer assumes no liability for damages arising from such changes.
However, the Developer will endeavor to announce significant changes via the Site and software release notes.

Operation in environments other than the above is not guaranteed. macOS and Linux are currently not supported.
The Software integrates with the following third-party services. Use of these services is subject to each service's terms of service.
The Developer assumes no liability for outages, specification changes, or discontinuation of third-party services.
The handling of user personal information in the Software is governed by the separately established Privacy Policy.
By using the Software, users agree to the contents of the Privacy Policy. For details on the scope of information collected, purposes of use, third-party sharing, and user rights, please refer to the Privacy Policy.
The Developer may revise these Terms as necessary. Revised Terms become effective upon posting on the Site. Users will be notified of significant changes on the Site.
Continued use of the Software after changes constitutes acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
If any provision of these Terms is held invalid or unenforceable by law, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be interpreted to the extent permitted by law to achieve its originally intended economic and legal purposes.
